1. Definitions

UAB Gamadigi, Trade mark – “Timber Date” is a company registered at: Gedimino street 47, Kaunas, Lithuania. Registration number 302829287, VAT number LT100007026913

‘The buyer’ is the person or company buying products from Timber Date

‘Goods’ refers to all products purchased by the buyer from Timber Date

2. Acceptance

This agreement applies to the advertisement, sale and service of all products offered by UAB Gamadigi

The buyer automatically accepts our terms and conditions when our products get purchased and agrees to follow basic operating procedures outlined in the user manual.

3. Products & Pricing

All quotations, price lists, delivery descriptions and publicity material are indicative only until confirmed in writing at the moment of purchase.

Prices on our site are in Euros unless otherwise stipulated. Delivery fees can be calculated at checkout or with a representative of Timber Date whilst placing an order over the phone or via email.

Prices do not include installation costs.

Images of products on our site are illustrative only, and there may be slight variances in colour/finish when produced in real life, due to the nature of working with timber products.

4. Payment terms

We accept bank transfers and online credit or debit card payments via Stripe.

Full payment of orders is required from The buyer before Goods can be despatched to a delivery address.

The buyer is not entitled to withhold monies or exercise any lien from payments due.

5. Delivery

Timber Date supplies and delivers to all of mainland EU territories using 3rd party delivery providers. Delivery prices may vary depending on your location.

We reserve the right to cancel your order if we do not deliver to your area.

Hot tubs are generally delivered by large van or flat bed trailer and the buyer must make sure that he/she has suitable access for this type of delivery.

Drivers will be helpful and try to comply with reasonable delivery requirements but it should be assumed that delivery is kerbside only with the customers manpower to offload the tub. We can try and organise 2 men delivery or crane services at additional cost. Moving goods from kerbside is at your risk and responsibility.

Where our driver is requested to or there is an implication that delivery should be made onto your property or any private property this may be done at the drivers discretion but is entirely at The buyers risk and responsibility.

Any damage incurred for deliveries outside the scope of kerbside only, owing to the weight of delivery vehicle / driver negligence or any other damage (including to the actual product) is entirely at your risk and you agree to be responsible for any costs in making good. Damage to lawns, flower beds, driveways adjacent to a narrow or difficult access route will be the responsibility of the customer.

If a hot tub is delivered by an articulated lorry it is assumed that you have lifting facilities at your end. On some occasions, a tail lift can be ordered at extra cost.

Difficult access, The buyer must advise us if there are access difficulties. We will endeavour to assist The buyer to deliver the Goods even in the most difficult access situations but please note that these types of operations may cost extra and it’s assumed as kerbside delivery unless agreed otherwise.

Any additional cost incurred to re-deliver any product because of access issues will be reimbursed to Timber Date by The buyer.

The delivery period stated is approximate and is usually between 2 and 7 weeks from the order (excluding over the Christmas and New Years period). All delivery periods stated are “advisory” and estimated. We shall have no liability whatever for delayed delivery.

The goods remain at risk of Timber Date until the point of delivery.

6. Acceptance

Once goods have been delivered please check them over and report any missing items or damage to the driver. They will be held at your own risk and we will not be liable for their loss or destruction after delivery.

7. Right of withdrawal

After receiving the order, The buyer has the right to withdraw from the contract concluded in the E-shop within 14 days if the order is not made according to The buyers needs.

In order to use the 14-day right of return, the ordered Goods must not be used in any other way than is necessary to make sure of the nature, characteristics and function of the Goods in a way that is allowed for testing the goods in a physical store.

If the goods have been used for any other purpose, or if they show signs of use or wear, Timber Date has the right to reduce or refuse the refundable fee according to the decrease in the value of the goods.

In order to return the goods, a statement of withdrawal from the purchase of the goods must be submitted and sent to the e-mail address [email protected] no later than 14 days after receiving the goods.
